1. ACCEPTANCE OF TERMS

By accessing or using Kuomba, you confirm that you have read, understood, and agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the Services.

We may update these Terms at any time. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

2. DESCRIPTION OF SERVICE

Kuomba is an all-in-one job search platform that provides:

• Job Scanner: Aggregates recently posted job listings from major career websites, updated every 15 minutes.
• Application Tracking: Lets you track jobs you have applied to and monitor application statuses.
• AI Document Generation: Creates tailored resumes and cover letters using artificial intelligence based on your profile and the job description.
• Browser Extension: Assists with auto-applying to jobs across supported platforms.

We reserve the right to modify, suspend, or discontinue any feature of the Services at any time without notice.

3. USER ACCOUNTS

To access most features, you must create an account. You agree to:

• Provide accurate and complete registration information.
• Keep your credentials confidential and not share them with others.
• Be responsible for all activity that occurs under your account.
• Be at least 18 years of age.
• Notify us immediately at [email protected] if you suspect unauthorized use of your account.

We reserve the right to suspend or permanently terminate accounts that violate these Terms or for any other reason at our sole discretion.

4. SUBSCRIPTION & PAYMENTS

In Short: Subscriptions auto-renew and are processed via Stripe. Cancel anytime; access continues until the end of the billing period.

• Billing: Paid plans are billed on a recurring basis (monthly or annual) through Stripe. By subscribing, you authorize Kuomba to charge your payment method on file.
• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
• Cancellation: You may cancel your subscription at any time through your account settings. You will retain access to paid features until the end of your current billing period. No partial refunds are issued for unused time.
• Refunds: Refund requests are evaluated on a case-by-case basis. To request a refund, contact [email protected].
• Price changes: We may change subscription prices at any time. We will notify you in advance of any price change affecting your active subscription.

5. PROHIBITED USES

You agree not to:

• Abuse our infrastructure: Send automated requests, scrape, or overload our API endpoints or any part of the Services in a manner that exceeds normal usage or disrupts service for other users.
• Circumvent rate limits: Attempt to bypass rate limiting or access controls. We reserve the right to rate-limit, throttle, or permanently ban any account or IP address that abuses our systems.
• Upload illegal or infringing content: Submit, upload, or transmit any content that is unlawful, defamatory, obscene, or that infringes the intellectual property rights of any third party.
• Misrepresent your identity: Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Reverse engineer or copy: Decompile, disassemble, or reverse-engineer any part of the Services, or copy any templates, designs, or features for use outside the platform.
• Violate applicable law: Use the Services for any purpose that is illegal under applicable law.

6. YOUR RESPONSIBILITIES & AI CONTENT

In Short: You are responsible for your data. Always review AI-generated content before using it.

• Resume accuracy: You are solely responsible for the accuracy, completeness, and truthfulness of all information you provide, including your resume data, work history, and skills.
• Review AI outputs: All resumes, cover letters, and other content generated by Kuomba's AI must be reviewed and verified by you before submission to any employer. Kuomba does not guarantee the accuracy, suitability, or completeness of any AI-generated content.
• AI limitations: AI outputs may contain errors, omissions, outdated information, or language that does not accurately reflect your experience. You assume full responsibility for any content you submit to third parties.

7. INTELLECTUAL PROPERTY

In Short: Kuomba owns the platform and generated templates. You own your personal data.

• Kuomba IP: The Kuomba platform, branding, software, and all AI-generated document templates are the exclusive intellectual property of BACAR Inc. and are protected by copyright and other applicable laws. You may not reproduce, distribute, or create derivative works from our templates outside of their intended use within the Services.
• Your data: You retain ownership of the personal information and raw data you input into the Services. By using the Services, you grant Kuomba a limited, non-exclusive license to process your data solely for the purpose of delivering the Services to you.
• Feedback: Any feedback or suggestions you provide to us may be used by Kuomba without any obligation to you.

8. NO EMPLOYMENT GUARANTEE

Kuomba is a tool to assist your job search — it does not guarantee any employment outcome. Job matches, AI-generated documents, and application assistance are provided as-is and for informational purposes only. We make no representation that using Kuomba will result in interviews, job offers, or employment.

9. SERVICE AVAILABILITY

We strive to maintain high availability of the Services, but we do not guarantee uninterrupted or error-free operation. Scheduled maintenance, unplanned outages, or third-party service failures may cause the Services to be temporarily unavailable. We are not liable for any loss or inconvenience resulting from downtime.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, BACAR Inc. and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of or inability to use the Services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of these Terms or the Services shall not exceed the amount you paid to Kuomba in the twelve (12) months preceding the claim.

11. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree that any dispute arising from these Terms or the Services shall be resolved exclusively in the courts located in Montreal, Quebec, Canada.
